A LEGAL DISCLAIMER
Zoukies Liability Waiver
I acknowledge that I am voluntarily participating in the Zouk Energy retreat, and I agree to the following:
1. Assumption of risks: I am aware that participating in the activities such as dance and meditation involves inherent risks, including but not limited to bodily injury, property damage and emotional distress. I understand and accept these risks voluntarily.
2. Health and fitness: I am physically and mentally capable to participate in the activities involved in the retreat. I take responsibility to inform the organisers, in advance, about medical conditions and physical limitations that may affect my ability to participate safely.
3. Release of liability: I hereby release, waive, discharge and covenant not to sue the organiser, staff and facilitators from all liability, claims, demands, actions or causes of action arising out of my participation in this retreat. Including and not limited to, personal injury, property damage, loss or theft or wrongful death caused by negligence or any other cause.
4. Indemnification: I agree to indemnify and hold harmless the organiser from any loss, liability, damage, cost, including attorney fees, arising out of or related to my participation at the retreat.
5. Medical emergency: In the event of a medical emergency, I authorise the organiser to seek and consent to treatment on my behalf. I take responsibility for any medical expenses incurred as a result of such treatment.
6. Photography and media: I consent to the use of photographs, video recordings and other media taken during the retreat for promotional and educational purposes by the organiser. I waive any right to compensation for the use of such materials.
7. Governing law: the liability waiver shall be governed by the laws of Jurisdiction and any disputes arising out of or related to this agreement shall be resolved through arbitration in Jurisdiction.
I have read this liability waiver in its entirety and understand the terms. I agree voluntarily to be bound by it provisions.
TERMS AND CONDITIONS - THE BASICS
Having said that, Terms and Conditions (“T and C”) are a set of legally binding terms defined by you, as the owner of this website. The T and C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T and C are meant to establish the legal relationship between the site visitors and you as the website owner.
T and C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T and C that are different from the T and C of a website only providing information (like a blog, a landing page, and so on).
T and C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.
WHAT TO INCLUDE IN THE T and C DOCUMENT
Generally speaking, T and C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
